Estate Planning

At the Law Office of David W. Knight, we have been providing sound counsel and advice in all areas of Estate Planning and Administration for over 25 years.

Whether your family needs counsel in the preparation and drafting of important Estate Planning documents, Conservatorships for aging loved ones, or assistance with Probating a Will, we are ready to assist you with reliable and compassionate counsel.

Our clients frequently can be heard to say,“We would have done this years ago if we had known it was going to be so easy.”

Proper Estate Planning has two main goals:  (1) Helping families to efficiently distribute assets to loved ones upon their passing. (2) Managing those assets during their lifetime.

Revocable Living Trusts

In many cases, our clients are interested in avoiding the time and expense of Probate through the drafting of a Revocable Living Trust. In addition to saving a great deal of time and money in the form of Probate Fees, Living Trusts also offer privacy for matters to be handled within the family and, in certain cases, can provide greater protection against Estate Taxes.

In addition, our aging loved ones can find themselves in need of assistance in managing financial and healthcare decisions in their later years. Properly drafted Durable Powers of Attorney and Advanced Healthcare Directives can provide the necessary authority to care for these loved ones.

Whether we are working with an individual or a married couple, our comprehensive Estate Planning Package for most families includes all of the following:

  1. Confidential Consultation
  2. Revocable Living Trust
  3. Certification of Trust
  4. Pour-Over Wills
  5. Durable Powers of Attorney for Property
  6. Advanced Healthcare Directives
  7. Custom Estate Planning Binder
  8. Notary and Recording Fees included

Probate Administration

Many individuals find themselves called upon to take care of the administration of a family member’s estate. The family member may have previously prepared a Will, or in some cases may not have prepared any form of Testamentary Documents. In such cases, a Probate Administration is often necessary.
The Probate process is most often a lengthy one, and is subject to specific statutory requirements and administrative fees.

Having the assistance of a knowledgeable and experienced attorney can insure that this challenging process moves forward smoothly during this stressful time.
